Lease agreement: a protection tool for the landlords

There are many out there, who are giving out their properties or a part of their properties on rent to the tenants. In order to safeguard the tenant as well as the landlord, lease agreement plays an extremely important role. If we go by the general definition of lease agreement, it is an authority authenticated paper, which is meant towards the tenant from the landlord. For the new tenant, signing this lease agreement and ageing to the terms mentioned in it is of vital importance. Lease agreement contains several rules and regulations, which the landlord expects the tenant to follow. Though nothing stringent about the nature of these regulations, these chart out the basic guidelines to living and handling of the property being lent out to the tenant. Since these are written on the authorized paper, these rules tend to act like the bible for the tenant and his mode of conduct in the rented property. Hence, it is compulsory for the tenant to agree with the agreement and sign it to prove his consent to the given mode of conduct.

In order to agree to the terms, however, the tenant first needs to understand all the points mentioned. This can be successfully achieved when the landlord reads the agreement paper to the tenant. In case of any confusions or misinterpretations, the pointers can be cleared there and then itself. Hence, with better understanding of the terms, the tenant can also be expected to execute them to the fullest. It also ensures that in case of the breach of the agreement, the landlord has full authority to question the tenant regarding the same.

Further, even though the tenant might have aid the advance sum of the rent of two or three months, with the agreement form duly signed and understood, the landlord too can relax.

In general, it is seen that a lease agreement covers points like late fee, minor repairs and so on. These points should be made clear between the landlord and the tenant in order to avoid any future conflicts arising out of these cases. In case of late fees, especially, one needs to be very careful about terming the clause in the agreement. Other factors like cleaning costs, property maintenance, security etc can also be looked into in the lease agreement. Furthermore, a lease agreement can also deal with subjects like the bringing of any unauthorized occupant in the property or dealing with illegal or obscure activities within the premises of the property. Unless the tenants agree to these terms, they cannot be allowed in.
Furthermore, in case the tenant is found to disobey the mentioned clauses, the landlord can also mention the punishment in the lease agreement. It can be either imprisonment or immediate withdrawal of the property from the tenant; all if mentioned in the agreement can make it much easier for the landlord to deal with these unpleasant situations smoothly.

A lease agreement therefore, secures the interests of the tenant as well as the landlord, saving each from inconsequential headaches and conflicts. Thus, apart from boosting a relationship between the landlord and the tenants, a lease agreement also helps in protecting the property and the landlord from difficult tenants!
